The Obama federal loan modification program is expected to benefit four to five million homeowners in America. Because foreclosure benefits neither the mortgage lender nor the homeowner, most lenders are eager to participate in this program, but they are not required to do so. Mortgage lenders agreeing to participate in Obama’s federal loan modification program must agree to Treasure Department guidelines and are given incentives to work with financially strapped homeowners to handle modifying loan requests.

MHA, or Making Homes Affordable, offers this list of current lenders taking part in the Obama federal loan modification program (in alphabetical order):

1. Bank of America.

2. Carrington Mortgage Services.

3. Chase.

4. CitiMortgage.

5. Countrywide.

6. GMAC.

7. Green Tree Servicing.

8. Home Loan Services, Inc.

9. Ocwen Financial Corp.

10. Saxon Mortgage Services.

11. Select Portfolio Servicing.

12. Wells Fargo Bank.

13. Wilshire Credit Corp.

More lenders are agreeing to participate in the federal loan modification program, so continue to check back for additions to the list. Ask your mortgage lender or bank if they are participating if you don’t see them listed above.

Even if you’ve previously been turned down by your individual lender, you may qualify and be eligible now under this new modify loan program. Completing the paperwork properly and adhering to the guidelines as set out by the government and the participation lender is the key to your modification approval. Don’t meet with your lender until you’ve gathered the appropriate documentation demonstrating your financial situation and filled out the application in detail, carefully checking for mistakes before you submit the information.

Preparing our paperwork in advance will improve your chances for gaining assistance under the new Obama federal loan modification plan.

Help is available through the Home Affordable Plan to homeowners struggling to make their monthly mortgage payments. Loan modifications can lower your monthly mortgage payment to help keep you in your home if refinancing is not a viable option for you. Below are some points concerning loan modification.

* Homeowners can extend their payment terms up to 40 years and reduce their interest rates by up to 2% using the Home Affordable Modification Plan. This plan allows homeowners who are suffering with financial difficulties to modify their loans based on hardship. This is an especially a good option for those who lost their jobs and don’t qualify for refinancing. It’s also a better option for those whose property values have declined or where the real estate market is still soft, preventing them from being able to sell their homes.

* If you’re insured under Fannie Mae or Freddy Mac, the plan requires that your mortgage be at least 105% of the current value and that your mortgage payments have not been more than 60 days late within the past 12 month period. For those unable to refinance, the loan modification plan provides current market rates for qualified homeowners.

* New guidelines have extended the FHA insured Hope for Homeowners plan to make it more available to qualified homeowners. Lenders participating in the federal loan modification program are incented to help you get your loan modified rather than face foreclosure.

Being prepared and gathering your documents together before meeting with your lender will give you a leg up

on your chances to qualify and be approved for a loan modification. Review the requirements, processes, and plans at sites to get an application for and prepare to request a loan modification. Be sure to complete the application correctly and follow the steps in detail so that to avoid delays or denials. You want to give quality to attention to the application because you are only allowed to apply once.

Loan Modification Program –

Get the facts & info you need to save your home!

What I’d like to share with you is that at least 2 or more million mortgages that were funded between 2000-2007, many of these loans were funded unlawfully. During that period, bankers, lenders, mortgage brokers, appraisers and others in the industry have been known to enjoy the benefits of a very prosperous time.

Many of these people performed their jobs well and honestly, but others performed their duties illegally. Prosecutions are on the rise as these predatory lending violators are being brought to trial.

This is what I feel you should know! Your loan may be unlawful, and you might be entitled to substantial damages whether or not you are currently in foreclosure. A detailed forensic loan audit performed by our attorney’s will help to discover any violations of federal, state and predatory lending practices. Approximately 85% of forensic loan audits to date have uncovered violations in the TILA (Truth in Lending Act), Good Faith Estimate, RESPA (Real Estate Settlement Procedures Act), and in the Predatory Lending and Real Estate/Mortgage Fraud regulations.

The forencis loan audit explained… A forensic loan audit is the of all documentation, legal paperwork, transaction data, and other evidence pertaining to a real estate loan that has already been funded. A Forensic Loan Audit identifies any illegalities performed by the lender, their broker, or other parties in conjunction with the loan. During the audit process, a professional will review your loan to make sure that it meets all legal requirements that were in effect when your the loan was funded.

Why is this audit so important? This simple and straightforward answer is, loans must be legal to remain enforceable by the lender. Loan violations are serious offenses of federal laws and lenders may face stiff fines and penalties for breaking the laws. For the most part, lenders and banks are firms run by reasonable business people. So, the lenders understand the financial mess they created, and want to avoid any possible large fines or being faced with expensive litigation.

How does a forensic audit help the homeowner? Mortgage violations are the basis by which your case can be argued with lenders. Generally, the more severe those violations are, the better your chances are of obtaining a favorable settlement.

This settlement can include punitive damages, attorney fees, more affordable loan terms (such as a lower interest rate, lower monthly payments and/or a principal reduction), a delay or prevention of a foreclosure sale and more. When you consider the chances of any lender getting a favorable jury decision in any court in the country, we now can see why the lender might be inclined to negotiate a settlement.

The best thing you can do is to hire an attorney who is skilled in mortgage lending and real estate law. And particularly one who knows and understand the forensic audit principals. A licensed attorney will determine the proper course of action. If your loan is found unlawful you will be entitled to compensation and other awards. At worst, you can be assured of an attractive loan modification on terms more to your needs.

Violations of the Truth In Lending Act carry severe penalties. Most of the recent prosecutions have centered around this document which in recent years was not properly disclosed and/or presented in the loan package. A creditor who violates the disclosure requirements may be sued for twice the amount of the total finance charge on the loan. In the case of a home mortgage, this can be a very significant amount. Costs and attorneys fees may also be awarded to the borrower.

Hardship assistance in the form of loan modifications has been available for years, but it’s the topic of conversation now more than ever since the Making Home Affordable (MHA) Act was introduced by President Obama. Unlike in years past, the process for applying and being approved for home loan modification is less inefficient and speedier. Investigate your options if you think that a home loan modification would assist you in your time of financial hardship.

It doesn’t have to be the end or result in foreclosure if you’re currently having difficulty making your monthly mortgage payments. If you apply for loan modification assistance before you hit rock bottom, you may be able to do something to save your home. A financial adviser can let you know your options, whether you hire one or schedule an appointment with a HUD-approved financial adviser for free counseling.

You have options available to you in terms of whether to choose a lawyer to assist you in obtaining loan modification approval and whether or not to use a free financial counselor or a paid adviser.

Whenever there’s increased demand for a product, new providers seem to crawl out of the woodwork. Be careful when choosing a lender or financial advisor to assist you with your financial decisions and consideration of a mortgage modification. Check with colleagues and/or the Better Business Bureau to check out the lender before deciding to do business with them.

When meeting with your counselor for the first time, you will need to take all of your documentation they will need. You will need your financial statements, bills, and any other relevant paperwork for the loan counselor to review.

You and your counselor will work together to write a hardship letter if it’s determined that loan modification is the best option for your particular situation. A hardship letter explains to your lender what caused your financial difficulties (Divorce? Job loss? Medical bills?) and lay out your strategy for how you plan to continue meeting your monthly loan obligations under modified terms.

Apply under the loan modification program if you are having difficulty paying your monthly mortgage due to financial hardship. Counseling is available free of charge to help you select and deal with a lender participating in the loan modification program.

News of downsizing and layoffs has been prevalent during these downturns in our economy. Those who have lost their jobs are concerned about meeting their bills, including their monthly mortgage payments and wonder if there’s any opportunity for them to participate in a loan modification program. That’s a valid concern considering that obtaining a loan usually requires the ability to repay the loan, which requires the borrower to have a job in order to earn income.

You are not alone if you are finding it more difficult to make your monthly mortgage payments. Millions of Americans are experiencing the same problems as you are facing. Foreclosure is a scary word that you don’t want to have to consider and there may be other options that will work better for you and your family. Don’t feel guilty about being in the situation that you find yourself – it’s not your fault.

Unemployment is income and if you are receiving unemployment insurance benefits, this would be something that a lender would look at while considering your application for a loan modification. What the banks are calculating to determine your qualifications for a loan medication is your debt to income ratio – the amount of your debt as a percentage of your total monthly income.

If you’re concerned about applying for loan modification while unemployed, you could wait, but don’t wait too long. Once you have a good lead on a job that you feel will pan out, that might be the time to apply for a new loan because your chances of loan approval improve in direct relationship to your financial situation.

If you have an exemplary work history and meet other qualifications of your mortgage bank or lender, you can sometimes attain approval of loan modification. This won’t be the case if you’ve had a sporadic work history or if your most recent job was of short duration.

There’s no hard and fast rule about approval for loan modification when you’re unemployed, whether or not you receive unemployment income. While you would hope that your unemployed status would only be short and temporary, a lender may not want to assume that risk of loaning you money without the ability to repay it.

A well-written hardship letter can make or break your ability to be approved for a loan modification. The hardship letter needs to lay out the reasons why you are facing financial difficulties and why you would be able to meet your mortgage obligations under revised terms.

Preparation is always the key to success, so preparing a checklist to guide you toward covering all aspects that need to be included in your hardship letter will increase your odds of approval. Below are the three key points that you need to include in your letter.

1. Explain why you are facing financial difficulties. Did you lose your job? Did you or a family number become seriously ill? Have you incurred an inordinate amount of medical expenses? Outline for your mortgage bank the circumstances that have put you in your current situation.

2. Create a chronology or timeline of your situation. What you want to be able to show the lender is that you weren’t late or delinquent in payments until extenuating unexpected circumstances arose that caused your current financial crisis. You’re showing the bank that you’ve been a responsible debtor up until the time of your financial hardship.

3. Develop a plan for your future. Let the lender know that you are a proud homeowner who wants to do everything within your ability to meet your debt obligations and continue to enjoy home ownership. If you plan to sell some items, let them know that. Outline a new budget for yourself and share that with the bank to show them that you are taking measures to protect your investment.

The key to loan modification approval is the hardship letter. By demonstrating to your lender that your current situation was beyond your reasonable control and making a promise to fulfill your future obligations, you will have a better chance of being approved for a mortgage loan modification.

Do you have questions about Obama’s loan modification program and who is eligible to participate in it? Are you wondering which financial institutions are providing loan modification options using the $75 billion allocated by the Treasury Department? Keep reading for some answers to these questions and more.

Lender participation in the federal program isn’t required, but many financial institutions have already signed up and many more are eager as modifying a loan is a much preferred alternative to foreclosure. Also, under Obama’s loan modification setup, lenders are being offered incentives to participate in this plan that is expected to protect four to five million American homeowners from losing their homes.

The federal loan modification program has the following requirements for eligibility:

- the loan being modified must be a first mortgage on your primary residence

- the loan being modified must represent a monthly payment > 31% of your monthly income

- the loan being modified must not be delinquent

- you must be able to provide proof of your income

In order to process your application for the federal modification program, you must provide the lender with a detailed hardship letter, a thoroughly completed application form, a detailed income statement, and proof of your debt. There is no fee associated with applying for modification under the Affordability and Stability Plan.

Not only are the lenders who agree to participate in the federal loan modification system being provided incentives, so too are homeowners. For example, if you pay your newly modified loan as required for five years, you may qualify to receive a $5,000 bonus.

Don’t procrastinate applying for relief through the federal loan modification program. Avoid the rush and inevitable glut of paperwork that’s going to start rolling in and get in front of your lender before the crowd.

Loan modification services are a great option for the majority of homeowners who are trying to modify their mortgage loan. For many, receiving a modification on their own is a difficult task. Lenders are firm on their requirements without additional pressure from an outside party, such as loan modification services.

When a lender looks over an application for modification, they have their eyes open for certain factors, mostly those pertaining to financial hardship. However; there are some things that the unsuspecting homeowner may not be aware of. For example, many don’t know that in most situations, a recent or current bankruptcy can be means for disqualification.

Finding a lender’s requirements for modification can be difficult or too time intensive for many, and sometimes the whole application process as a whole is too stressful. For these reasons, relying on a company offering loan modification services is wholly a good idea.

Loan modification services can be provided by one of two sources: companies or FHA-appointed and approved representatives.

The main difference between the two sources of assistance are price – though there are some others that vary between providers.

FHA-appointed representatives are a result of the Home Affordable Modification Program. They are certified professionals and all of their services, even lender negotiations, are completely free. The only downside to FHA representatives is that in some cases there can be a waiting list for assistance.

Loan modification services provided by a company are also usually given by professionals, though their backgrounds and specific expertise can vary. There are situations where paid services can actually provide better results such as an even lower interest rate or faster turn times.

Besides the fees, there is one notable and significant downside to relying on a company: Scams. Not all companies are scams, but a large portion of them are as there was little to no regulation on modification companies until recently.

The most significant sign that a company is a scam is the request of an immediate These scam companies will usually charge even before the consultation, and many homeowners are not aware of the risk. But the possibility that they will take the money and run is very real.

Despite the risks, fees, or waiting times loan modification services are almost a necessity for homeowners considering requesting a modification on their mortgage from their lender.
